In this wide-ranging interview Priscilla Alderson discusses how she came to research parental and childhood consent and became a sociologist and how, late in her career, she became convenor of the critical realism group started by Roy Bhaskar at the Institute for Education in London. She discusses aspects of her seminal research over the years on multiple subjects, such as the rights of children, and reflects on what critical realism has added to her social research.

In the past three decades a number of narrative self-concepts have appeared in the philosophical literature. A central question posed in recent literature concerns the embodiment of the narrative self. Though one of the best-known narrative self-concepts is a non-embodied one, namely Dennett’s self as ‘a center of narrative gravity’, others argue that the narrative self should include a role for embodiment. Several arguments have been made in support of the latter claim, but these can be summarized in two main (...) points. Firstly, a logical one: without taking the body into account Dennett’s theory becomes self-refuting. Secondly, a more practical/phenomenological point: a disembodied self-concept overlooks how personal the body is, and as such should be considered part of the self. In this paper I endorse these criticisms of non-embodied narrative self-concepts, but I argue that the relationship between the narrative self and the body is far from sufficiently fleshed out. I claim that the narrative self and the body are much more interwoven than the above criticisms suggest. What I aim to show in this paper is that the relationship between the body and the narrative self is interactive rather than unidirectional: not only does our body shape our narrative self, but our narrative self also shapes our body. The upshot of this is a better conception of the self is as a dynamic interaction between its various aspects. (shrink)

This discussion paper considers how seldom recognised theories influence clinical ethics committees. A companion paper examined four major theories in social science: positivism, interpretivism, critical theory and functionalism, which can encourage legalistic ethics theories or practical living bioethics, which aims for theory–practice congruence. This paper develops the legalistic or living bioethics themes by relating the four theories to clinical ethics committee members’ reported aims and practices and approaches towards efficiency, power, intimidation, justice, equality and children’s interests and rights. Different approaches (...) to framing ethical questions are also considered. Being aware of the four theories’ influence can help when seeking to understand and possibly change clinical ethics committee routines. The paper is not a research report but is informed by a recent study in two London paediatric cardiac units. Forty-five practitioners and related experts were interviewed, including eight members of ethics committees, about the work of informing, preparing and supporting families during the extended process of consent to children’s elective heart surgery. The mosaic of multidisciplinary teamwork is reported in a series of papers about each profession, including this one on bioethics and law and clinical ethics committees’ influence on clinical practice. The qualitative social research was funded by the British Heart Foundation, in order that more may be known about the perioperative views and needs of all concerned. Questions included how disputes can be avoided, how high ethical standards and respectful cooperation between staff and families can be encouraged, and how minors’ consent or refusal may be respected, with the support of clinical ethics committees. With the increase in the costs of providing education and concerns about financial responsibility, heightened consideration of accountability and results, elevated awareness of the range of teacher skills and student learning styles and needs, more focus is being placed on the promises offered by online software and educational technology. One of the most heavily marketed, exciting and controversial applications of edtech involves the varied educational programs to which different students are exposed based on how big data applications have evaluated their (...) likely learning profiles. Characterized most often as ‘personalized learning,’ these programs raise a number of ethical concerns especially when used at the K-12 level. This paper analyzes the range of these ethical concerns arguing that characterizing them under the general rubric of ‘privacy’ oversimplifies the concerns and makes it too easy for advocates to dismiss or minimize them. Six distinct ethical concerns are identified: information privacy; anonymity; surveillance; autonomy; non-discrimination; and ownership of information. Particular attention is paid to whether personalized learning programs raise concerns similar to those raised about educational tracking in the 1950s. The paper closes with discussion of three themes that are important to consider in ethical and policy discussions. (shrink)

Background: The law and literature about children’s consent generally assume that patients aged under-18 cannot consent until around 12 years, and cannot refuse recommended surgery. Children deemed pre-competent do not have automatic rights to information or to protection from unwanted interventions. However, the observed practitioners tend to inform young children s, respect their consent or refusal, and help them to “want” to have the surgery. Refusal of heart transplantation by 6-year-olds is accepted. Research question: What are possible reasons to explain (...) the differences between theories and practices about the ages when children begin to be informed about elective heart surgery, and when their consent or refusal begins to be respected? Research design, participants and context: Research methods included reviews of related healthcare, law and ethics literature; observations and conversations with staff and families in two London hospitals; audio-recorded semi-structured interviews with a purposive sample of 45 healthcare professionals and related experts; interviews and a survey with parents and children aged 6- to 15-years having elective surgery (not reported in this paper); meetings with an interdisciplinary advisory group; thematic analysis of qualitative data and co-authorship of papers with participants. Ethical considerations: Approval was granted by four research ethics committees/authorities. All interviewees gave their informed written consent. Findings: Interviewees explained their views and experiences about children’s ages of competence to understand and consent or refuse, analysed by their differing emphases on informed, signified or voluntary consent. Discussion: Differing views about children’s competence to understand and consent are associated with emphases on consent as an intellectual, practical and/or emotional process. Conclusion: Greater respect for children’s practical signified, emotional voluntary and intellectual informed consent can increase respectful understanding of children’s consent. Nurses play a vital part in children's practitioner-patient relationships and physical care and therefore in all three elements of consent. (shrink)

This article reviews practitioners’ evaluations of in-hospital ethics seminars. A qualitative study included 11 innovative in-hospital ethics seminars, preceded and followed by interviews with most participants. The settings were obstetric, neonatal and haematology units in a teaching hospital and a district general hospital in England. Fifty-six health service staff in obstetric, neonatal, haematology, and related community and management services participated; 12 attended two seminars, giving a total of 68 attendances and 59 follow-up evaluation interviews. The 11 seminars facilitated by an (...) ethicist addressed the key local concerns of staff about the social and ethical consequences of advances in genetics and their impact on professional policies and practice. Seminar agendas were drawn from prior interviews with 70 staff members. During evaluation interviews, participants commented on general aspects that they had enjoyed, how the sessions could be improved, timing, the mix of participants, the quality of the facilitation, whether sessions should be more challenging, after-effects of sessions, and interest in attending seminars and contacting the ethicist in future. Participants valued the increased interprofessional understanding and coherent discussion of many pressing issues that addressed important though seldom discussed ethical questions. The seminars worked well in the different hospitals and specialties. (shrink)

Background: While there have been studies exploring moral habitability and its impact on the work environments of nurses in Western countries, little is known about the moral habitability of the work environments of nurses and midwives in resource-constrained settings. Research objective: The purpose of this research was to examine the moral habitability of the work environment of nurses and midwives in Ghana and its influence on their moral agency using the philosophical works of Margaret Urban Walker. Research design and participants: (...) A critical moral ethnography was conducted through the analysis of interviews with 30 nurses and midwives, along with observation, and documentary materials. Ethical considerations: After receiving ethics approval, signed informed consent was obtained from participants before data collection. Results: Five themes were identified: (1) holding onto the values, identities, and responsibilities of being a midwife/nurse; (2) scarcity of resources as limiting capacity to meet caring responsibilities; (3) gender and socio-economic inequities shaping the moral-social context of practice; (4) working with incoherent moral understandings and damaged identities in the context of inter- and intra-professional relationships; and (5) surviving through adversity with renewed commitment and courage. Discussion: The nurses and midwives were found to work in an environment that was morally uninhabitable and dominated by the scarcity of resources, overwhelming and incoherent moral responsibilities, oppressive conditions, and workplace violence. These situations constrained their moral agency and provoked suffering and distress. The nurses and midwives negotiated their practice and navigated through morally uninhabitable work environment by holding onto their moral values and commitments to childbearing women. Conclusion: Creating morally habitable workplaces through the provision of adequate resources and instituting interprofessional practice guidelines and workplace violence prevention policies may promote safe and ethical nursing and midwifery practice. Background: The literature and research on nursing ethics and advocacy has shown that generally very few nurses and other clinicians will speak up about an issue they have witnessed regarding a patient advocacy concern and that often advocacy in nursing is not learned until after students have graduated and begun working. Objective: To evaluate the effectiveness of narrative pedagogy on the development of advocacy in student nurses, as measured by the Protective Nursing Advocacy Scale. Design: We tested the hypothesis that (...) use of a narrative pedagogy assignment related to ethics would improve student nurse’s perception of their advocacy role as measured by the Protective Nursing Advocacy Scale using a quasi-experimental nonrandomized study using a pre-test, intervention, post-test design. Data collection occurred during class time from October 2012 to December 2012. The Protective Nursing Advocacy Scale tool was administered to students in class to assess their baseline and was administered again at the completion of the educational intervention to assess whether narrative pedagogy was effective in developing the nursing student’s perception of their role as a patient advocate. Ethical considerations: Students were informed that their participation was voluntary and that the data collected would be anonymous and confidential. The survey was not a graded assignment, and students did not receive any incentive to participate. The institutional review board of the college determined the study to be exempt from review. Setting: School of Nursing at a small liberal arts college in the Northeastern United States. Participants: A consecutive, nonprobability sample of 44 senior-level nursing students enrolled in their final nursing semester was utilized. Findings: Results indicated significant differences in student nurse’s perception of their advocacy role related to environment and educational influences following an education intervention using an ethics digital story. Conclusion: Using the Protective Nursing Advocacy Scale, we were able to measure the effectiveness of narrative pedagogy on nursing student’s perception of the nurse’s advocacy role. (shrink)

The sociology of literature, in the first of many paradoxes, elicits negations before assertions. It is not an established field or academic discipline. The concept as such lacks both intellectual and institutional clarity. Yet none of these limitations affects the vitality and rigor of the larger enterprise. We use the sociology of literature here to refer to the cluster of intellectual ventures that originate in one overriding conviction: the conviction that literature and society necessarily explain each other. Scholars and critics (...) of all kinds congregate under this outsize umbrella only to differ greatly in their sense of what they do and what sociology of literature does. They subscribe to a wide range of theories and methods. Many would not accept the sociology of literature as an appropriate label for their own work; other would refuse it to their colleagues. Nevertheless, every advocate agrees that a sociological practice is essential to literature. For the sociology of literature does not constitute just one more approach to literature. Because it insists upon a sociology of literary knowledge and literary practice within the study of literature, the sociology of literature raises questions basic to all intellectual inquiry.The sociology of literature begins in diversity. The way that is combines the ancient traditions of art with the modern practices of social science makes the very term something of an oxymoron. There is not one sociology of literature, there are many sociological practices of literature, each of which operates within a particular intellectual tradition and specific institutional context. These practices cross basic divisions within the contemporary intellectual field, especially within the university. Inherently interdisciplinary, the sociology of literature is subject to constant reformulation as scholars re-evaluate their disciplines. In consequence, disciplinary boundaries seem less rigid, less logical, and, hence, less authoritative than ever before. Even so—and this is another paradox of the sociology of literature—any sociological conception of literature is best situated in terms of an original discipline and its institutional setting. However frequently individual scholars cross over disciplinary lines, the fundamental divisions retain their force. This Article doDespite obvious differences in the Aristotelian and Stoic theories of responsibility, there is surprisingly a deeper structural similarity between the two. The most obvious difference is that Aristotle is (apparently) a libertarian and the Stoics are determinists. Aristotle holds adults responsible for all our "voluntary" actions, which are defined by two criteria: the "origin" or cause of the action must be "in us" and we must be aware of what we are doing. An "involuntary" action, for which we (...) are not responsible, is one that fails to meet either one of these two criteria. Aristotle is a libertarian insofar as he insists that all voluntary actions are "in our power" to perform or not. As determinists the Stoics cannot admit this sort of freedom, but they still consider the agent to be a vital link in the chain of events, so they redefine what is "in our power" as what comes about "through us." The terminology is different, but I argue that these actions, for which the Stoics hold us responsible, are in fact coextensive with Aristotle's voluntary actions. An "impression" is the first necessary condition for action, and is a sort of visual image of the object stimulating one to act. The right sort of impression activates the agent's "impulse," an internal movement of soul or mind, which is the direct cause of action. But impulse is always accompanied by "assent," which is the mind's affirming the truth of the proposition that we ought to go after the object stimulating our impulse. Thus, since assent is a necessary condition for action, we always act knowing what we are doing. This means that all actions caused by our own impulse and assent are by Aristotle's criteria voluntary, where impulse provides the internal origin of the action and assent provides the awareness of what is being done. I conclude that the Stoic and Aristotelian classes of what one is responsible for are coextensive, their criteria defining responsible actions are nearly identical, and the only substantial difference is that Aristotle claims such actions are in our power to do or not do while the Stoics say that such actions are necessitated (by our internal nature as well as external factors). es not have an abstract. As a study involving diabetes care demonstrates, children sometimes have a much more sophisticated capacity for taking charge of their own health care decisions than is usually recognized in bioethics. Protecting these children from their disease means involving them in their treatment as much as possible, helping them to understand it and take responsibility for it so that they can navigate the multitude of daily decisions that become part of the diabetes medical regimen.

Recent studies of semantic memory have investigated two theories of optimal search adopted from the animal foraging literature: Lévy flights and marginal value theorem. Each theory makes different simplifying assumptions and addresses different findings in search behaviors. In this study, an experiment is conducted to test whether clustering in semantic memory may play a role in evidence for both theories. Labeled magnets and a whiteboard were used to elicit spatial representations of semantic knowledge about animals. Category recall sequences from a (...) separate experiment were used to trace search paths over the spatial representations of animal knowledge. Results showed that spatial distances between animal names arranged on the whiteboard were correlated with inter-response intervals during category recall, and distributions of both dependent measures approximated inverse power laws associated with Lévy flights. In addition, IRIs were relatively shorter when paths first entered animal clusters, and longer when they exited clusters, which is consistent with marginal value theorem. In conclusion, area-restricted searches over clustered semantic spaces may account for two different patterns of results interpreted as supporting two different theories of optimal memory foraging. We use the construct of the “other” to explore how hate operates rhetorically within the virtual conclave of Stormfront, credited as the first hate Web site. Through the Internet, white supremacists create a rhetorical vision that resonates with those who feel marginalized by contemporary political, social, and economic forces. However, as compared to previous studies of on-line white supremacist rhetoric, we show that Stormfront discourse appears less virulent and more palatable to the naive reader. We suggest that Stormfront provides a (...) “cyber transition” between traditional hate speech and “reasonable racism,” a tempered discourse that emphasizes pseudo-rational discussions of race, and subsequently may cast a wider net in attracting audiences. El presente artículo analiza sentencias de la Corte Interamericana de Derechos Humanos para detectar si en ellas se ha realizado una interpretación intercultural que pudiera salvar aquellas críticas referidas al etnocentrismo de estos derechos. La reflexión se sitúa desde la filosofía hermenéutica y desarrolla una metodología cualitativa de investigación que como técnica utiliza la revisión documental. This study examined the relation between professional affiliation and the framing of expert congressional testimony about nicotine's addictiveness. Experts were chosen from three different types of sponsoring organizations: the tobacco industry, government, and independent research organizations, both pro- and anti-tobacco. The study sought to identify common technical biases and policy concerns that could define an overall “expert” attitude, as well as differences where the experts’ framing of nicotine addiction would reveal attempts to favor their own institutions. Semantic network analysis was (...) applied to each group's discourse, thereby clustering associated words that represented major themes in each type of expert group. Clusters revealed a common preoccupation with narrowly defined, lab-based evidence, but more locally, each group framed the issues to support its sponsor's strategy. (shrink)

Pregnancy and childbirth have become a dangerous journey for Black women as harrowing stories of death and near‐death experiences resonate within Black communities. While the causes of pregnancy‐related morbidity and mortality are well documented, little is known about how Black Canadian women feel protected from undesirable maternal health outcomes when accessing and receiving pregnancy and intrapartum care. This critical qualitative inquiry sheds light on Black women's perceived sense of safety in accessing pregnancy and intrapartum care. Twenty‐four in‐depth interviews were conducted (...) with Black women who were pregnant or had given birth. Five interconnected themes were generated through thematic analysis: (1) There is a lot of prejudice towards us, (2) We are treated as sick bodies, (3) There is a lot of stereotypes towards us, (4) Our care is lacking in quality, and (5) We feel unsafe in the healthcare system. These themes highlight the perils faced by Black women accessing pregnancy and intrapartum care. The right to safe motherhood and equitable care for Black women should be a national priority in Canada to avert a looming crisis. (shrink)

These can all be undermined by unseen influences: the history of adult-centric ethics; developmental psychology theories; legal and financial pressures that require consent to be defined as an adult contract; management systems and daily routines in healthcare that can intimidate families and staff; social inequalities. Mainstream theories in the clinical ethics literature markedly differ from the living bioethics in clinical practices. Conclusion We aim to contribute to raising standards of respectful paediatric bioethics and to showing the relevance of virtue and feminist ethics, childhood studies and children’s rights. (shrink)

En Allemagne, un genre artistique explore particulièrement cette problématique : le théâtre documentaire dont les formes contemporaines montrent la nette évolution des médias de masse et de leur rôle dans notre société. Cette approche documentaire soulève plusieurs questionnements quant à la véracité des faits et théories exposés, aux limites floues entre fiction et réalité, mais aussi quant à la pseudo-objectivité des propos diffusés. Par ailleurs, l’intrication de l’emploi esthétique de médias divers et d’une volonté de popularisation de discours politiques rapproche de facto l’art documentaire d’un art de la propagande non-officielle et interroge sur les motivations des dramaturges impliqués, entre détournement distancié et manipulation du public. Les expressions contemporaines héritées du théâtre documentaire se retrouvent dans des cadres dépassant la scène, prenant plutôt la forme de « projets » multi-supports et plurimédiaux présentés par des collectifs artistiques tels Zentrum für politische Schönheit (Centre pour la beauté politique) ou The International Institute for Political Murder de Milo Rau. The forensic speechs are excellent source for the knowledge of Athenian law. The laws were used in the speeches to make them more persuasive. The Demosthenes’s speech Against Meidias is an example of the persuasive use of the law. The orator uses the laws to guarantee a legal base for the process and to characterize he and his enemy as good and bad citizens, respectively. The text will analyse the different uses of law made by Demosthenes in the referred speech.

The primary focus of this article is a reading of Venus Hottentot 2000, a performance-text that reperforms the hyperbolization of Black female sexuality. In using the corporeality of the Black body as a strategic site of postcolonial resignification, this performance is moreover an interrogation of the colonial gaze that has fetishized the Black body. In foregrounding Venus Hottentot 2000 as a point of departure for exploration, the article proceeds by delving broadly into the representational history of the ‘Hottentot’ female. Furthermore, (...) to facilitate an understanding of the constitutive power of the colonial gaze and the possibilities of subverting and displacing that gaze from that of a postcolonial diasporic aesthetic practice, the article frames the postcolonial feminist reading of Venus Hottentot 2000 via an investigation of the processes by which the ‘Hottentot’ female has been festishized and scopically objectified within colonial discourse - processes whereby the ‘Hottentot’ female became a signifier of Black female sexuality. The article concludes by reading this performance as an example of a postcolonial ‘cultural war of positioning’, which offers moreover a contemporary rescripting of Black subjectivity. (shrink)

This article explores the relations between autobiography, fiction and history in the recent texts of Hélène Cixous. It examines the uses and limits of a range of generic categorizations in accounting for these relations. We suggest that most categorizations tend to rely on an underlying oppositionary and exclusive dynamic between autobiography and fiction in which one or the other may be privileged. Our contention is that Cixous's work should rather be understood within an inclusive dynamic in which all three elements, (...) the fictional, autobiographical and the historical coexist in a complex relation which cannot be disentangled. This inclusive dynamic, we suggest, is not only central to an understanding of the texts’ generic dimensions, but also to the specifics of the pact which Cixous establishes with her readers, as well as to the ethical thinking which underlies her oeuvre. In _Encounters with Melanie Klein: Selected Papers of Elizabeth Spillius_ the author argues that her two professions, anthropology and psychoanalysis, have much in common, and explains how her background in anthropology led her on to a profound involvement in psychoanalysis and her establishment as a leading figure amongst Kleinian analysts. Spillius describes what she regards as the important features of Kleinian thought and discusses the research she has carried out in Melanie Klein's unpublished archive, including Klein's views on projective identification. (...) Spillius's own clinical ideas make up the last part of the book with papers on envy, phantasy, technique, the negative therapeutic reaction and otherness. Her writing has a clarity which is very particular to her; she conveys complicated ideas in a most straightforward manner, well illustrated with pertinent clinical material. It is frequently, but incorrectly, claimed that Socrates said “All I know is that I know nothing.” The source of this misquote is Plato’s dialogue the Apology, where there are five Socratic claims that may appear to justify it. I review these five claims in their context to prove that they are not equivalent to, nor do they imply, the infamous quote. What Socrates does say is that he does not think that he knows anything that he does not in (...) fact really know. O presente texto é uma reflexão para a atuação de professores em salas de aula do ensino básico a partir de uma compreensão alargada da expressão interesse do aluno. Como docentes orientadoras do Programa Residência Pedagógica (2018-2019), pudemos observar que uma das mais frequentes preocupações dos professores e dos nossos alunos residentes ao longo da sua atuação na escola é aproximar as experiências e vivências dos alunos dos conteúdos, habilidades e competências que se pretendem ensinar. Buscaremos delimitar alguns significados e (...) pressupostos dessa preocupação, em que a noção de interesse do aluno parece ocupar um lugar proeminente. Tentaremos apresentar e defender um alargamento desta noção, incluindo nela os interesses comuns, partilhados, públicos ou publicizáveis dos alunos na medida em que são estudantes. Defenderemos que é esta noção alargada que precisa ser levada em conta pelas estratégias de aproximação entre as experiências e vivências dos alunos e os conteúdos, habilidades e competências escolares. Ater-se apenas aos interesses particulares ou mais subjetivos dos alunos é, em primeiro lugar, um procedimento inviável; em segundo lugar, significa incentivar cada vez mais os indivíduos a operarem em suas bolhas privadas, privando-os de compartilhar um espaço comum, por princípio igualitário, o que proporcionaria um processo comunitário de formação humana. Midwives and nurses play a critical role in safeguarding the lives of women in resource-constrained African countries. Working within the context of scarce resources may undermine their moral agency and hinder their ability to care. The purpose of this paper is to understand the influence of resource scarcity on midwifery and nursing care and practice. A critical ethnography was conducted in the obstetric department of three tertiary-level facilities in Ghana. Purposive sampling was used to recruit 30 midwives and nurses and (...) semistructured interviews, field notes and documentary materials were used to generate in-depth understanding. Ethical approval was granted from Canada and Ghana and written, and ongoing informed consent was obtained from the participants. Five conceptual themes depicting the impact of scarce resources on midwifery and nursing care were discovered: compromised care, constrained care, dehumanized care, missed care and disengaged care. Improving the maternal health of women and averting avoidable maternal morbidity and mortality require governments and institutions to invest in health infrastructure that will support the delivery of ethical and safe midwifery care for women in their most vulnerable period. This paper describes a strategy for getting students interested in ancient, especially Hellenistic, philosophy. While the works of Aristotle, the Stoics, the Skeptics, and the Epicureans may strike students as impossibly distant in time and thus far removed from their own personal concerns, students are always interested in the topics of free will and moral responsibility. Teaching the transition from Hellenic to Hellenistic philosophy through an emphasis on treatments of these topics engages students and makes feasible the teaching of an (...) understudied, extremely important period in Western philosophy. The author advocates focusing specifically on the debate between Aristotle and the Stoics on whether “being able to do otherwise” is a necessary condition for freedom. After presenting a detailed overview of the arguments that comprise this debate, the author offers suggestions on how this strategy might be augmented and on how to apply this strategy to courses which do not focus exclusively on ancient philosophy. Este artigo pretende retomar a interpretação que pode ser chamada de tradicional das três condições do ato propriamente virtuoso expostas em EN II 4, i.e., o conhecimento, escolher deliberadamente o ato por ele mesmo e seguir-se de uma disposição firme e não hesitante. A atenção da análise será voltada à primeira e à terceira condição. Buscar-se-á mostrar que a condição do conhecimento pode ser compreendida como conhecimento das circunstâncias, do ato ele mesmo como virtuoso e das técnicas ou ofícios que (...) podem ser por ele requeridos. Buscar-se-á igualmente justificar a introdução do termo ‘disposição’ na tradução apresentada, já que o termo grego ‘hexis’ não consta na passagem analisada. Um apontamento será feito, por fim, no sentido de oferecer uma justificativa mais ampla para a interpretação aqui defendida na medida em que a localiza como um posicionamento contrário à concepção intelectualista socrática. A series of eight multidisciplinary conferences on consent to health care and research was held in London during the period 1992 to 1995. The aim was to present a rich and varied account of consent from the perspectives of academics (especially social scientists), practitioners, and people affected by personal experience. This report summarizes some of the main contributions.

El artículo analiza el desarrollo de la interseccionalidad como concepto presente en el proceso de juzgar con perspectiva de género, en particular, su impacto en la jurisprudencia de la Corte Interamericana de Derechos Humanos (Corte IDH). La metodología utilizada es cualitativa, principalmente, revisión de sentencias de la Corte IDH. De las 13 sentencias seleccionadas en el período 2015-2022 se concluye que la Corte IDH ha incorporado progresivamente la perspectiva interseccional y la ha usada como categoría analítica para estudiar, entender y (...) hacer frente a las discriminaciones que constituyen una forma agravada de discriminación y barreras de acceso a la justicia. The following short contributions add to the debate on transplantation: one describes the distress of a woman recently widowed when asked for the organs of her dead husband for transplantation, and the other the eagerness with which a boy awaits the death of a potential kidney donor - not a heartless emotion but the longing for a new lease of life.

Purpose– The purpose of this paper is to develop a conceptual framework to contextualize young people’s lived experiences of privacy and invasion online. Social negotiations in the construction of privacy boundaries are theorized to be dependent on individual preferences, abilities and context-dependent social meanings.Design/methodology/approach– Empirical findings of three related Ottawa-based studies dealing with young people’s online privacy are used to examine the benefits of online publicity, what online privacy means to young people and the social importance of privacy. Earlier philosophical (...) discussions of privacy and identity, as well as current scholarship, are drawn on to suggest that privacy is an inherently social practice that enables social actors to navigate the boundary between self/other and between being closed/open to social interaction.Findings– Four understandings of privacy’s value are developed in concordance with recent privacy literature and our own empirical data: privacy as contextual, relational, performative and dialectical.Social implications– A more holistic approach is necessary to understand young people’s privacy negotiations. Adopting such an approach can help re-establish an ability to address the ways in which privacy boundaries are negotiated and to challenge surveillance schemes and their social consequences.Originality/value– Findings imply that privacy policy should focus on creating conditions that support negotiations that are transparent and equitable. Additionally, policy-makers must begin to critically evaluate the ways in which surveillance interferes with the developmental need of young people to build relationships of trust with each other and also with adults. The break necessary to establish a rigorous science of cultural works is something more and something else than a simple methodological reversal.1 It implies a true conversion of the ordinary way of thinking and living the intellectual enterprise. It is a matter of breaking the narcissistic relationship inscribed in the representation of intellectual work as a “creation” and which excludes as the expression par excellence of “reductionist sociology” the effort to subject the artist and the work of art to a (...) way of thinking that is doubly objectionable since it is both genetic and generic.It would be easy to show what the most different kinds of analysis of the work of art owe to the norms that require treating works in and for themselves, with no reference to the social conditions of their production. Thus in the now-classic Theory of Literature, René Wellek and Austin Warren seem to advocate “an explanation in terms of the personality and the life of the writer.” In fact, because they accept the ideology of the “man of genius” they are committed, in their own terms, to “one of the oldest and best-established methods of literary study”—which seeks the explanatory principle of a work in the author taken in isolation .2 In fact, this explanatory principle resides in the relationship between the “space” of works in which each particular work is taken and the “space” of authors in which each cultural enterprise is constituted. Similarly, when Sartre takes on the project of specifying the meditations through which society determined Flaubert, the individual, he attributes to those factors that can be perceived from that point of view—that is, to social class as refracted through a family structure—what are instead the effects of generic factors influencing every writer in an artistic field that is itself in a subordinate position in the field of power and also the effects specific to all writers who occupy the same position as Flaubert within the artistic field. 1. Many existing studies postulate that in developing economies philanthropy tends to dominate in the CSR orientation delivered by organizations and expected by local populations. To assess this in the emerging economy of Dubai in the United Arab Emirates, we conducted a preliminary investigation of how locals are responding to the growing number of CSR initiatives that are being implemented in the Emirate. Moreover, given that scholars have argued that Islamic principles of philanthropy should guide CSR initiatives in Muslim countries, we (...) also consider if our Emirati respondents connect CSR with Islamic philanthropy. Results from our survey of 267 local Muslim consumers in Dubai indicate that CSR is not typically equated with philanthropy. In addition, respondents displayed an appreciation of the economic benefits that CSR can generate. The implication is that organizations in Dubai no longer need to base their CSR on the platform of Islamic philanthropy as many scholars have argued. Our findings are significant for the wider Gulf region in that they suggest that in wealthy emerging nations, CSR may not be predominantly interpreted as the corporate philanthropy which is needed in poorer developing economies for the provision of infrastructure, schools, hospitals, and housing, and which in some Muslim contexts is also implemented because of local religious values. El presente artículo revisa la incorporación de un método interseccional en el análisis de casos, particularmente la aplicación de un análisis interseccional de la discriminación hacia las mujeres en los desarrollos de la Corte Interamericana de Derechos Humanos y en las sentencias del Tribunal Europeo de Derechos Humanos. La investigación permite visualizar, por un lado, la interseccionalidad como un método de análisis de casos de derechos humanos mediante dos conceptos fundamentales: la especial situación de vulnerabilidad y la interrelación de factores (...) de discriminación; y, por otro, las brechas sobre su utilización en ambos tribunales de derechos humanos. L’article situe l’importance de renommer les femmes et féministes d’origine autochtone, une manière de défaire les discours coloniaux (parfois tenus par des universitaires féministes) sur les pratiques de genre avant la colonialité/modernité. Ochy Curiel illustre cette idée à partir de l’expérience du GLEFAS (...) (Groupe latino-américain de formation et d’action féministe) : le décolonial n’y est pas seulement une critique du savoir académique, il est profondément ancré dans des pratiques autogestionnaires de luttes anticapitalistes, dans le lesbianisme politique, dans la rue, dans les associations, dans les organisations communautaires. Cet article s’attaque au manque d’informations sur les nombreux conflits de distribution écologique (EDC) provoqués par l’extractivisme minier en Inde au cours de ces dernières années. Le minerai de fer est le métal le plus extrait en Inde et, par conséquent, les conflits liés à cette activité sont importants. Nous analysons ici neuf conflits majeurs surgis dans différents états de l’Inde. Dans l’analyse de ces cas, nous mettons l’accent que les conséquences de l’extractivisme prédateur dans le secteur de l’exploitation des (...) minerais, ainsi que leurs impacts environnementaux, sociaux et culturels sur les régions minières « périphériques » de l’Inde. Neste artigo, busca-se articular a noção de juventude romântica como ideal de formação no pensamento do estudante Benjamin. Nos primeiros ensaios dedicados a temas pedagógicos, o filósofo propôs um novo modelo de educação apoiado no romantismo, partindo de uma crítica às instituições de sua época que cindiram a totalidade e a unidade da vida do jovem. Em seus escritos enquanto era estudante, Benjamin recupera, com sua crítica, a necessidade de olhar a arte, a literatura, a educação, em suma, toda a (...) cultura humana, como um conjunto reunido de vivências históricas. O romantismo, no pensamento de Benjamin, será, portanto, basilar às discussões pedagógicas. A juventude, vista como comunidade, tem o dever de ser criadora, de se transformar em uma convenção de gênios do tempo presente, em seus espaços de atuação, ou seja, nas instituições de formação. De modo geral, só é possível perceber e adquirir o saber específico de uma profissão se as instituições acadêmicas perceberem que devem visar à formação universal, pelo modelo de criação do gênio, pois a juventude é entendida como aquela que garante a produção de valores novos, opostos aos da experiência - sinônimo de rigidez dos conhecimentos - que não estabelecem vínculo com a vida. Para encontrar essa verdade da vida, é necessário um ato de coragem e de sentido para se estar, assim, diante de espíritos livres. A juventude, dessa forma, traduz-se como um conceito ou categoria humana dependente de um despertar da consciência de si mesma. Diante disso, conseguirá promover mudanças dentro do âmbito institucional-escolar e acadêmico, mas, ao mesmo tempo, esse despertar da consciência histórica do jovem definirá um modo específico de se lidar com a cultura humana. Portanto, neste artigo, sob à luz dos aspectos românticos, procurou-se mostrar a juventude como categoria humana, com faixa etária determinada, cercada de preocupações acerca da realidade escolar e acadêmica e, também, do ponto de vista universal, isto é, filosófico-pedagógico, como uma categoria do pensamento que significa a vanguarda, tudo aquilo que não está determinado e fixado, criando novos preceitos e formas de vida. La restitution des artefacts pillés lors des conquêtes coloniales ou abritées dans les musées « coloniaux » suscite des réactions antagoniques. Faut-il « tuer » le modèle du musée ethnographique, comme le préconise le président du Mali, ou bien purifier les collections témoins de pratiques génocidaires, en les radiographiant ou les cachant dans les réserves muséales, à l’abri des regards critiques? La complicité entre le pouvoir académique et le principe d’inaliénabilité de la propriété muséologique rendent le processus de restitution particulièrement (...) lent. Pour éviter que la restitution soit récupérée, des réponses rapides ont été conçues pour mieux correspondre aux imaginaires et pratiques de la jeunesse africaine: musée numérique, muséologie critique, institutions de culture populaire et restitution « en mode rapide ». Plutôt que de se focaliser sur des objets iconiques, la restitution en mode rapide cherche à revisiter l’ingéniosité traditionnelle précoloniale pour développer de nouvelles techniques, de nouvelles œuvres d’art et de nouveaux objets à finalité sociale et spirituelle. Women in developing countries suffer considerable moribidity and mortality due to inability to control their own fertility and lack of access to family planning services. Over 500,000 deaths each year are related to pregnancy. Two thirds of these maternal deaths could be prevented by providing contraception to those women who wish to use it in developing countries. There is no tenable ethical defence of cultural and religious behaviour which denies a woman a choice as to whether she will undertake a (...) pregnancy or not. Implementation of the principles of the programme ofactionfrom the 1994 Cairo Population Conference would, through empowering women to control their own fertility, have a huge impact on maternal health in the developing world. This article explores the relations between autobiography, fiction and history in the recent texts of Hélène Cixous. It examines the uses and limits of a range of generic categorizations in accounting for these relations. We suggest that most categorizations tend to rely on an underlying oppositionary and exclusive dynamic between autobiography and fiction in which one or the other may be privileged. Our contention is that Cixous's work should rather be understood within an inclusive dynamic in which all three elements, (...) the fictional, autobiographical and the historical coexist in a complex relation which cannot be disentangled. This inclusive dynamic, we suggest, is not only central to an understanding of the texts’ generic dimensions, but also to the specifics of the pact which Cixous establishes with her readers, as well as to the ethical thinking which underlies her oeuvre. With the world's population aging, hospitals are facing pressure to adequately meet the needs of a growing number of frail older patients. For this population, comorbidities combined with a limited ability to face stressful situations contribute to frailty whereby a small injury or illness can lead to significant loss of function. Un mouvement environnemental sans précédent a pris forme lorsque le gouvernement du Bangladesh a projeté la construction d’une centrale à charbon à 14 km des Sundarbans, la plus grande mangrove du monde. Plusieurs experts, dont certains de l’Unesco, ont indiqué que les déchets et la fumée de la centrale menaceraient la forêt et sa biodiversité. Malgré cela, le gouvernement persiste dans son intention de mener à bien le projet en fonction des intérêts de certains groupes au pouvoir. Le mouvement a (...) débuté discrètement en 2012 et est devenu massif par la suite. En 2017, il a réussi à mobiliser la mouvance du militantisme écologique et certaines organisations internationales. Il s’agissait de faire pression sur le gouvernement pour qu’il abandonne le projet d’usine. Cet article présente une revue des mouvements de justice environnementale en Inde, à partir d’une combinaison d’informations provenant de l’Atlas de la justice environnementale (EJAtlas), de travaux de terrain et d’une analyse de la littérature secondaire. L’auteur souligne ici l’intensité des conflits, les armes judiciaires qui confortent les manifestations et le changement des slogans avec le temps, ainsi que les synergies et les alliances anciennes et actuelles entre ces mouvements indiens. Pour l’analyse sont combinés l’utilisation de statistiques descriptives et quelques (...) exemples concrets. Enfin, il est proposé un débat sur la signification du terme « succès » appliqué à la justice environnementale, sujet sur lequel des recherches plus approfondies s’avèrent nécessaires. (shrink)

Entre le scénario d’arrivée de nouveaux gouvernements de droite et celui du retour au progressisme, l’Amérique du Sud fait preuve d’une instabilité politique et d’une crise de gouvernement qui montre la fin des structures politiques de consensus qui l’ont gouvernée ces dernières décennies. Alors qu’au Chili et dans d’autres pays, l’année 2019 a offert un panorama de nouvelles protestations, la période post-pandémique pourra peut-être engendrer une nouvelle mobilisation politique contre les formes actuelles de gouvernance et les arrangements politiques qui l’accompagnent.
